United States law provides protections to authors of original works that can be reproduced, such as photographs, movies or songs. Those protections, known as photo copyright release form, give the copyright holder the right to reproduce, distribute, display or perform the protected works.
What Is a Photo Copyright Release Form?
Copyright release form is generally known as a legal document drafted and signed by the owner of a copyright. It gives the title of the protected work, the name of the author, and specifies who can do what with the work. This authorization is given by the owner of the images also known as “releasor” and will be given to other people known as “releasee”.
Unless otherwise noted in the form, the release does not expire.

How Do We Got Permission?
In general, the permissions process involves a simple five-step procedure:
- Determine if permission is needed
The first step in every permission situation is to determine whether you need to ask for permission. In other words, do you need an agreement or can you use the work without permission? (sneaky sneak mode on). - Identify the owner
Identifying the owner of the work you want to use is crucial to obtaining permission. Often, you may be able to locate the rights owner just by looking at the copyright notice on the work. - Identify the rights needed
Each copyright owner controls a bundle of rights related to the work, including the right to reproduce, distribute, and modify the work. Because so many rights are associated with copyrighted works, you must specify the rights you need. This can be as simple as stating your intended use. - Contact the owner and negotiate whether payment is required
The primary issue that arises when seeking permission is whether you will have to pay for the permission you seek. Sometimes, the owner of the work will not require payment if the amount you wish to use is small, or if the owner wishes to contribute to an educational or nonprofit effort.
What Are The Structures of Photo Copyright Release Form?
1. Date Date of the day when the releasor authorize the permission to the releasee.
2. Names of both party State who owns the copyright. The photographer’s full name, signature and the studio he works for is mandatory. Include additional contact information such as an email address, phone number, mailing address and social media account names. It also recommended to include the releasee name or company, in order to avoid of any kind of misuse.
3. Description of all licensed photographs Describe and name the images(s) to be released. In addition to the digital file name or film strip identification number, give a visual description of the photo. If the file name is changed, or negative is trimmed, the visual description will verify the identity of the released image.
4. Explain the release usage. Outline whether the person may use the photo to make additional hard copies, give the photo to media for publication in newspapers or websites or use the photo in any manner they would like.
5. Indicate whether the photographer gets a photo credit. Although the photo is released, the original creator of the artwork may require that his name or studio be attached to the image whenever it is displayed or copied.
6. Signature of the releasor. The most important thing from the whole explanation.
Specifically in the United States, a photographer can get in real trouble for using someone’s likeness commercially without acquiring the release form from the subject. Likewise, it is an illegal act by the law for a client to commercially use images from a photographer without a photo copyright release form.
